Three duties, in plain language
1. Tell people they’re talking to AI.
If a customer could reasonably think they’re chatting with a human, you must inform them it’s an AI — clearly, at the start. (Art. 50(1): exemption when it’s already obvious to a reasonably well-informed person.)
2. Make sure AI-made content is marked.
AI-generated images, audio, video and text must carry a machine-readable mark showing they’re synthetic — a duty that applies since 2 August 2026 (tools already on the market before that date have a transitional period until 2 December 2026, under Reg. (EU) 2026/1744, the “Digital Omnibus”). It sits mainly with the AI tool’s provider, but you’ll want your published content to carry proper marks, and some labeling duties are yours directly. (Art. 50(2).)
3. Label deepfakes and AI news-like text visibly.
If AI content shows real people, places or events — or if AI-written text informs the public on matters of public interest — you must disclose it visibly, not just in metadata. (Art. 50(4), with narrow exemptions we explain in the check.)
